Welcome to Águas Vivas - Freediving Centre!
These general conditions of sale are agreed between Mário José Baltazar de Carvalho, with headquarters in Travessa do Montinho, lot 4 R/C Direito 7645-212 Nova de Milfontes, Tax Identification Number: 212404130 and contact +351 962282863, hereinafter referred to as “Águas Vivas“ and people who wish to make purchases through the website www.aguasvivasapneia.com, hereinafter referred to as “User”. The parties agree that purchases made through the website www.aguasvivasapneia.com will be governed exclusively by this contract to the exclusion of any conditions previously available on the website.
ARTICLE nº 1 – OBJECT
1 -The purpose of these general sales conditions is to provide and define all the information necessary for the User regarding ordering, selling, payment and delivery methods for purchases made on the website www.aguasvivasapneia.com.
2 - These conditions regulate all the steps necessary to place an order and guarantee its follow-up between the Contracting Parties, just as reservations and appointments for activities and training are processed.
ARTICLE nº 2 – ORDER
The User places their order by completing the purchase process presented on the website www.aguasvivasapneia.com, adding the product(s) or service(s) they wish to order to the shopping cart. To send your order, the User must: Register on the website www.aguasvivasapneia.com providing the requested information for this purpose. Log in (providing a combination of email and password chosen by the User when registering). Complete the information and choose the options that are available to you throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the NIF and the name that, for tax purposes, you want appear on the invoice). The final confirmation of the order by the User is equivalent to full acceptance and completed prices and description of the products available for sale as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded. Águas Vivas (Mário Carvalho) will honor orders received online only up to the limit of available stocks. If the product is unavailable, Águas Vivas undertakes to inform the User as soon as possible. The data contained in the invoice is the sole responsibility of the User. The invoice once issued cannot be reissued with changes. Order requests are valid for 7 days, unless the order is registered under a promotional campaign that defines a different deadline, and it is not possible to guarantee prices, discounts, promotions and offers beyond this period.
If payment is not received by our services within the aforementioned period, the order will not be validated. Any amount received after this date will be returned or used for a new order.
ARTICLE nº3 – PAYMENT
1 - On the website www.aguasvivasapneia.com, the following payment methods are proposed to the User:
Transfer via PayPal;
Bank transfer;
Payment in cash – Available for in-person withdrawals at Headquarters.
Cash on delivery for each situation and only for mainland Portugal, the Azores and Madeira, not authorized for promotions.
ARTICLE nº 4 – DELIVERY
Orders will be shipped within 30 working DAYS after placing the order. Delivery is carried out through CTT or by a courier, depending on the weight, volume and destination of the order. Shipping costs will be added to the ordered products, which vary according to their weight and dimensions and the packaging that will contain them. ARTICLE #5 – PRICES Prices must be understood in “Euros” €, with fees and taxes included, taking into account the VAT in force on the date of payment of the order. If there is an increase in the price of any product, the User will be informed immediately, and may choose to receive their order (paying the difference) or cancel it.

ARTICLE nº 6 – CANCELLATION AND RETURN
The cancellation or return process is handled on a case-by-case basis, by Águas Vivas (Mário Carvalho). The request must arrive in writing to the contact email aguasvivas.apneia@gmail.com, up to 2 days after placing the order, with instructions for canceling or returning the merchandise answered and defined by Águas Vivas (Mário Carvalho), by the same means of communication. Whenever possible, the return must be made using the same payment method, but if this is not possible, the user must present proof of payment and account or card ownership, so that the return can be made by Bank Transfer. Águas Vivas (Mário Carvalho) undertakes to reimburse the User within a maximum period of 30 days.
Returned products must be in salable condition, that is, in the same condition in which they arrived in the User's hands, without any anomaly or damage. If the value resulting from the exchange of products in an order is lower or higher than the initial value of the order, the settlement conditions will be indicated by Águas Vivas (Mário Carvalho).
ARTICLE Nº7- RETURNS AND WITHDRAWALS
For any returns and/or withdrawals, you must contact our services as soon as possible. All situations will be analyzed promptly, and our service may or may not accept it and/or require payment of expenses that have already been incurred following the order (example: shipping costs). Returns of used material are not accepted.
ARTICLE Nº 8 - VOUCHERS
Our Vouchers are valid for one year and are non-refundable. In special cases, proven long-term illnesses, they may be extended for another year.
ARTICLE Nº 9 - COURSE RESERVATIONS AND SCHEDULING
Course reservations and schedules are only effective after confirmed payment of 50% of the value of each activity, and are not refundable in case of cancellation, as they limit the spaces for other people to take advantage of our offer during that period.
